Lessor hereby grants Lessee use of the portable storage unit, assigned by the Lessor, pursuant to the terms of this storage rental agreement:

1.) LEASE OF SPACE - Occupant agrees to pay to Owner, as rent for and during the entire term of the Agreement. The sum agreed upon shall be paid on the 1st of the month and each month thereafter. Rent shall be paid online by credit card, Venmo, PayPal or check (made payable to M&M Peels LLC). Should Occupant hold over and retain possession of said storage space after the expiration of this Agreement, his occupancy of said storage space shall be from month to month at the prevailing rate and that all covenants and conditions contained herein shall continue in full force and effect.

2.) SECURITY DEPOSIT - Occupant shall pay to Owner the sum of one month’s rent which shall be used as a security deposit. The security deposit will be refunded when the unit is vacated, only if:

Occupant has given written notice seven (7) days prior to the vacation of the unit.
Occupant's fees, including all late fees and other charges are paid in full.
The unit is returned at least broom clean when vacated.

The late charge depends on the size of the unit and will be charged on any fee paid after its due date.

If Occupant tenders a check that is returned or refused by any financial institution for any reason whatsoever, Owner will add a penalty of $25.00 for the bad check fee and further may exercise any and all rights provided under the laws of Ohio.

3.) PERMITTED USE OF SPACE - The above referred to space shall be used solely for the purpose of storing personal property. Occupant agrees that he will not store any illegal explosive, flammable, corrosive or toxic materials in this space and that he will not use the space for any illegal purposes or for the storage of any illegal items. The Occupant also agrees to comply with all applicable Federal, State, Municipal, or County regulations, ordinances and statutes. The rules and regulations of the Owner are hereby made a part of this agreement. No vehicles shall be left parked overnight outside this space. No signs or any appurtenances will be allowed without the advance written consent of the Owner. The Occupant agrees to be responsible for all of his trash and garbage removal and agrees that no burning shall be permitted on the owner's premises.

Lessee acknowledges that the unit will not be used as a dwelling, place of business, or for any purposes other than storage of personal property.

4.) LIMITATION OF LIABILITY - Occupant acknowledges that this storage space leased by him has not been provided with air conditioning, heating, electricity and ventilation systems, and does not provide for temperature, humidity, or other climatic control. Owner shall not be liable for any damage or Injury which may be sustained by any loss, damage or injury sustained due to fire, water damage, burglary, theft, mysterious disappearance, rodents or acts of God. The Owner shall not be liable for any personal Injury to the Occupant or Occupant's agents or employees or any members of the public visiting the Occupant, and the Occupant agrees to hold the Owner harmless from any such claims, and agrees to identify for the Owner for and such loss by all claims, including attorney fees Incurred by the owner. The parties to this Agreement agree that the Owner is only making space available to the Occupant and does not accept Occupant's goods for storage and is not liable in any manner for the safe-keeping of those goods, nor is the owner responsible as a warehouseman for the stored goods.

5.) INSURANCE - Owner carries no Insurance on Occupant's contents for injuries or damages sustained in the storage space or the use thereof. Insurance on property stored in the rented storage space for loss caused by fire, water, theft, Acts of God, or otherwise, may be obtained at Occupant's expense, and Owner shall not be responsible for any such loss whatsoever.

6.) LIEN OF LESSOR, THE PARTIES AGREE THAT THE OWNER SHALL HAVE A LIEN ON ALL PERSONAL PROPERTY STORED IN OCCUPANT’S SPACE FOR ANY CHARGES DUE UNDER THIS AGREEMENT - This lien attaches to the personal property of the Occupant on the date the personal property is brought to the storage facility. If no payment has been received for a continuous period of fifteen (15) days subsequent to a default by the Occupant under this Agreement, then the property stored in Occupant's space will be sold. The proceeds of the sale will first be used to pay the costs of the sale and any remainder will be applied against the payment due under this Agreement. Notice of sale of property and any surplus proceeds from sale will be sent to Occupant at address given above.

7.) LOCK-OUT PROVISIONS - The Owner shall have the right to place a lock on the door of the Occupant’s space if the rent has not been received within seven calendar days after it becomes due. Such lock will serve as notice to the Occupant that the rent is due and not paid pursuant to this Agreement. The lock shall be removed, during business hours only, within twenty-four (24) hours after receipt of payment.

8.) ABANDONMENT - The Occupant shall be deemed to have abandoned the premises if, absent written notice to the owner to the contrary, all the property is removed from the rental unit for a period of ten (10) days and the Occupant has failed to make his monthly payment before the due date.

9.) ACCEPTANCE OF UNITS - The Occupant agrees that he has examined the units that are the subject of this Agreement, and the premises are now in acceptable condition and suitable for the purpose for which they are leased.

10.) MODIFICATION OF PREMISES - The Occupant agrees that no modification of the leased units shall be made without prior written consent of the owner. The Owner shall have the right to compel the Occupant to remove any modifications, alterations or fixtures and to return the unit to the condition at the time the Agreement was signed.

11.) ASSIGNMENT OF PREMISES - Occupant agrees that the units shall not be subject to assignment or sublease without the prior written consent of Owner.

12.) RIGHT OF ENTRY - Occupant agrees that Owner, or Owner's agents, employees or other representatives, shall have the right to enter onto Occupant's premises, at all reasonable hours, for the purpose of examining the unit or making such repairs as necessary for the safety or preservation thereof, or to comply with the terms of this agreement. This clause shall not be construed to create an obligation to make such inspection or repairs, except to the extent otherwise provided herein. Occupant also grants Owner the right to remove any lock or other security device of the Occupant securing without notice to the Occupant, if the Occupant is in default under this Agreement. The Occupant agrees that the Owner will not be responsible for any loss, theft or damage to the Occupant's goods which may occur after the owner's lock or other security device has been removed.

13.) TERMINATION AND EVICTION - Owner may, at his option, terminate this Agreement and evict Occupant upon Occupant's failure to pay rent or any other fees specified herein when due, to comply with the terms of this Agreement or to comply with any State or Local ordinance without notice of any type to Occupant. If the Occupant becomes insolvent or if bankruptcy proceedings are filed by or against the Occupant, this Agreement is cancelled immediately. In the event of termination of this Agreement, Occupant shall remain liable for any rents and charges that may be in arrears and for such damages as may be incurred by Owner as a result of Occupant's non-compliance. This Agreement may be cancelled by the Occupant for any reason by giving the owner written notice ten (10) days prior to the intended cancellation date. The Owner may terminate this agreement or modify the conditions of it, including a change in the storage fee, by giving the Occupant written notice thereof at least ten (10) days before modification is to take effect.

14.) ATTORNEY FEES - The Occupant will be responsible for reasonable attorney fees incurred by the Owner for the enforcement of the provisions of the Agreement and for the collection of any sums due, whether or not legal proceedings are actually filed.

15.) MODIFICATION OF PAYMENT - The terms of this Agreement may be modified or amended only by written notice signed by the Owner. The waiver of any provision of this Agreement by the Owner shall not constitute a waiver of the provisions in the future or a waiver of any other provisions of this Agreement at any time.

16.) LIABILITY OF PROVISION - If at any time any of the provisions of this Agreement are held invalid or unenforceable, for any reason, it shall not affect the validity or enforceability of the remainder of the Agreement.

17.) ENTIRE AGREEMENT OF PARTIES - This Agreement constitutes the entire Agreement between the parties and is not subject to oral modification. This Agreement shall be binding upon the parties hereto and their respective heirs, successors assigns. This agreement shall be governed by the laws of the State of Ohio.

1.) Lessee agrees to lease the portable storage unit and shall have the option to store the unit with the Lessor or have the unit kept at the Lessee’s designated location, on a month to month basis beginning on the date agreed upon. This storage rental agreement shall remain in full effect until canceled by either party.

2.) The Lessee shall pay the first week’s or month’s rent upon delivery and will pay a rental fee agreed upon for the rental of the storage unit on the day it’s delivered. In the event the Lessor does not receive rent for a given month when due, the Lessee will be charged a late fee of $25.00. In the event of a returned check the Lessee shall pay a $25.00 return check fee.

3.) If Lessee wants the portable storage unit transported to Lessee's designated location, the Lessee agrees to pay for all transportation costs of the storage unit, including but not limited to, drop off fee, curb to curb fee and final pick-up fee.

4.) Lessor will endeavor to place the portable storage unit in an area pursuant to Lessee's instructions. Lessee represents that the area for placement shall have adequate size, clearance (at least 15' in height), and structural integrity to sustain the weight and size of the unit, delivery truck and any other related equipment. If Lessee fails to provide placement instructions to Lessor prior to delivery or if Lessor otherwise determines, in its sole discretion, that the area for placement pursuant to Lessee's instructions does not have adequate size or clearance for the unit, Lessee authorizes Lessor to then place the portable storage unit in any other area on Lessee's premises to the extent reasonably possible under the circumstances to include an area immediately accessible from a street fronting Lessee's premises. In all cases, Lessee authorizes Lessor to drive on Lessee's lawn, non-paved area or any other part of Lessee's premises in order to place or retrieve the unit and Lessee assumes full risk for any damage to Lessee's premises and releases Lessor from any such damage resulting from the delivery, placement and retrieval of the unit. Any deliveries or retrievals of the unit as described herein requiring Lessor to access the unit by way of non-paved areas shall permit Lessor, at its option, to assess Lessee a service charge, which Lessee agrees to pay. There shall be no rent or delivery fee refunds for Lessor's inability to deliver the unit through no fault of Lessor. Lessee agrees that Lessee will not relocate the unit. In the event it is determined that the unit has been relocated, Lessee agrees to pay an additional fee that was agreed upon of the unit plus any cost or shipping associated with the retrieval of the unit.

5.) Lessee shall use the storage unit for storage purposes only and will not store live animals, trash or refuse or perishable goods inside the premises.

Lessee acknowledges that the unit will not be used as a dwelling, place of business, or for any purposes other than storage of personal property.

The Lessee may not store anything outside of the assigned portable storage container while housed at the Peel’s Portables facility.

6.) The property inside the unit is the sole responsibility of the Lessee. The Lessor does not assume or imply responsibility for the Lessee's property at any time. Upon cancellation of this storage rental agreement, the lessee shall have 24 hours to remove all property from the unit being rented. Any property remaining in the unit past that time shall be deemed abandoned and shall become the property of the Lessor. The Lessor shall not be liable for any damages that may incur from the items being stored.

7.) Cleaning fees will be charged to the Lessee at a rate of $50.00 per hour. All disposal fees will be charged to the Lessee for any items left in the box. The Lessee will keep the unit rented in clean and well-kept condition at all times during this storage rental agreement.

8.) Should periodic maintenance or repairs be necessary, the Lessor agrees to notify the Lessee 24 hours prior to making such repairs.

9.) This Lease shall be subject to the jurisdiction of Ohio.

10.) The Lessee understands there will be no provided security for the storage unit and all property stored will be the sole responsibility of the Lessee. No bailment shall be created. The Lessor will not be responsible for any loss or damages that may incur from the storage of property.

11.) Lessee agrees to be held solely responsible for any damage to the rented portable storage unit beyond normal wear and tear, as defined by law. Should damage beyond wear and tear be discovered, the Lessee agrees to pay for such damages prior to retrieving their property from the storage unit.

12.) Either party may request the termination of this agreement with 30 days prior written notice. Notification must be in written form and either hand delivered or sent via certified mail to the other party.

13.) The following events shall be deemed to be events of default by Lessee under this Agreement: a) Lessee fails to pay any installment of the rent due under this Agreement. b.) Lessee fails to comply with any term, provision or covenant of this Agreement other than the payment of rent and does not cure such failure within ten (10) days after written notice thereof to Lessee. c.) Lessee abandons the unit.

14.) If an event of default shall occur and so long as such default shall be continuing, Lessor may at any time thereafter at its election: a.) Deny Lessee access to Lessee's property stored in the unit. b.) Immediately terminate this Agreement by giving notice to Lessee. c.) Enter upon Lessee's premises and take possession of the unit and Lessee's property stored in the unit. d.) Expel or remove Lessee from the unit, without being liable for prosecution or any claim of damages. e.) CHARGE LESSEE ALL EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) INCURRED BY LESSOR THAT ARE CONNECTED WITH THE COLLECTION OF ANY AND ALL OUTSTANDING BALANCES OWED BY LESSEE. f.) Pursue any other remedies provided for under this Agreement or at law or in equity. In the event that Lessor repossesses the unit, Lessee hereby consents to Lessor attending the Lessee's premises and such repossession and waives Lessee's claim for trespass and/or conversion and agrees that Lessee shall not hold Lessor liable for any damage or loss to Lessee's property or Lessee's premises arising from said repossession. Lessor's remedies, including its lien rights, are cumulative and any or all thereof may be exercised instead of or in addition to each other or any other remedies available to Lessor at law or in equity.

15.) This storage rental agreement may not be amended, redacted. or otherwise altered except through written amendment signed by both parties.

16.) Any provision of this storage rental agreement deemed unenforceable, illegal, or unfair by a court of law shall be replaced by an acceptable article accomplishing the same basic goal of protecting both parties and their rights as they relate to this storage rental agreement.
